		<description><![CDATA[How to deal with Gay Marriage without infringing on religion or discriminating against the citizens of this country?]]></description>
			<content:encoded><![CDATA[<p><a href="http://www.riggsbyreport.com/wp-content/uploads/2010/09/gaymarriage.jpg"><img class="alignleft size-medium wp-image-1257" title="gaymarriage" src="http://www.riggsbyreport.com/wp-content/uploads/2010/09/gaymarriage-300x91.jpg" alt="" width="300" height="91" /></a>Ok, so there seems to be this big issue about Gay Marriage. California is up in arms about it on both sides. Carrie Prejean was drummed out of Miss USA over it. Glenn Beck is being beaten up for his lack of opposition to it, and Brad and Angelina won’t get married until it’s settled. For some strange reason it’s a big issue.</p>
<p>Mike Huckabee said, &#8220;I don&#8217;t have to prove that marriage is a man and a woman in a relationship for life. They have to prove that two men can have an equally definable relationship called marriage, and somehow that that can mean the same thing.&#8221;</p>
<p>Well, Governor, I see how you came to this conclusion.  While we agree on many things, when it comes to this, I respectfully disagree.  When it comes to religion, you are correct. However, when the people in the history of this country, for some strange reason, decided to involve the government in marriage, then it shifted the burden of proof onto those who would tell citizens of this country that they do not have the same rights as other citizens.</p>
<p>So, here is the conundrum: We believe in equal protection under the law, and we believe in freedom of religion. So, how do we allow the people whose religion does not accept homosexuality to maintain their “sanctity” of marriage without discriminating against other citizens of our free nation?</p>
<p>My best friend and I were talking and had worked up a solution. I think the main point was his and we expounded on it enough that I will say it was his idea and I put some window dressing on it.</p>
<p>Anyway what we discussed was this:</p>
<p>First: The government needs to get out of marriage. It should not be defined by government whatsoever. Leave it to the individual churches to define marriage and then people can marry based on their religion. The GLBT community can choose churches where gay marriage is accepted and cherished. Those who oppose it can choose churches that feel the same and can continue to not acknowledge the gay marriages as they see fit.  Everyone can address marriage according to his or her religious beliefs.</p>
<p>Now, what about things like division of assets, custody, things like that? These are huge issues in today’s modern world. We have a solution for that. Each state can draft up a basic generic contract that divides all assets 50/50, grants medical power of attorney, and shares custody of any future children of the relationship.  This contract will be available for the price of the former marriage license. Go down to the courthouse, pay your money, sign the contract and have it notarized and you are good to go.  It’s that simple. But what if it isn’t that simple? What if it’s more complicated? Then you go to an attorney and draft the contract that you want. Then have it signed and notarized. This is essentially the same thing that happens with marriage now, only it reduces the government’s involvement to what it really should be and that is arbiter of the contract.</p>
<p>So now, we have equality across the board without the government getting involved in anyone’s religion. All it takes is the first state to sign on. That state could remove the government’s involvement in marriage. It could give it’s constituents 6 months to obtain a new contract. (For those already married, you could waive the fee. ) Then when someone moves into the state who is married, you could give them 3 months to obtain a contract. After that, they cannot divorce in the state and they have no marital rights in the state. Then maybe it would catch on. I think this would be a good compromise for everyone on both sides of this discussion and I hope we can discuss this more.</p>

<p>Ok, It has happened. Barack Hussein Obama, 44th President of the United States has committed treason. How, you ask? Article III Section III of The Constitution of the United States of America defines treason as:</p>
<h5><strong>Section 3.</strong> Treason against the United States, shall consist only  in levying War against them, or in adhering to their Enemies, giving  them Aid and Comfort. No Person shall be convicted of Treason unless on  the Testimony of two Witnesses to the same overt Act, or on Confession  in open Court. The Congress shall have power to declare the Punishment  of Treason, but no <a title="Attainder" href="http://en.wikipedia.org/wiki/Attainder">Attainder</a> of Treason shall work Corruption of  Blood, or Forfeiture except during the Life of the Person attainted.</h5>
<p>Let&#8217;s break it down. Someone who crosses our border illegally with the intention of breaking our laws is a foreign invader, thus an enemy of this nation. Barack Obama has ordered the Justice Department to sue the State of Arizona to prevent it from apprehending foreign invaders. This would be &#8220;adhering to their Enemies, giving  them Aid and Comfort.&#8221;</p>
<p>Once the lawsuit was filed, it was admitted to in open court. I believe that Barack Obama should be Impeached and charged with treason and that the only conclusion that the impeachment can draw is guilty and removal from office.</p>

		<description><![CDATA[How does the Declaration of Independence apply to our current government?]]></description>
			<content:encoded><![CDATA[<p><a href="http://www.riggsbyreport.com/wp-content/uploads/2010/07/veteransday_flag.jpg"><img class="alignleft size-medium wp-image-1229" title="Flag" src="http://www.riggsbyreport.com/wp-content/uploads/2010/07/veteransday_flag-300x205.jpg" alt="American Flag" width="300" height="205" /></a>As we celebrate our independence from an oppressive government, I think it would be a good idea to look at those original complaints and see how they apply to our situations today.</p>
<p>Here is the list of complaints outlined in the Declaration of Independence and my take on how they compare to today&#8217;s government.</p>
<p><em>He has refused his assent to laws, the most wholesome and necessary for the public good. </em></p>
<p>Our current Congress and President consistently ignore the Constitution of the United States. They passed a Health Care Bill that has no basis in the Constitution, there is no ability to intervene, yet they do. They took control in the GM bankruptcy, giving money to the union before the stockholders, ignoring the law. Then they ignore immigration law and give aid and comfort to enemies of the United States.</p>
<p><em>He has forbidden his governors to pass laws of immediate and pressing importance, unless suspended in their operation till his assent should be obtained; and when so suspended, he has utterly neglected to attend to them. </em></p>
<p>Barack Obama is suing the state of Arizona for passing a law protecting it’s people from the foreign invaders.</p>
<p><em>He has refused to pass other laws for the accommodation of large districts of people, unless those people would relinquish the right of representation in the legislature, a right inestimable to them and formidable to tyrants only. </em></p>
<p>They have manipulated the rules of the Senate to negate the representation of the American People, when they passed an unpopular Health Care Bill by using an improper procedure to skirt the filibuster.</p>
<p><em>He has called together legislative bodies at places unusual, uncomfortable, and distant from the depository of their public records, for the sole purpose of fatiguing them into compliance with his measures. </em></p>
<p>They consistently set votes at 1:00 AM and on Christmas Eve in hopes that Representatives will vote just to get it finished.</p>
<p><em>He has dissolved representative houses repeatedly, for opposing with manly firmness his invasions on the rights of the people. </em></p>
<p><em>He has refused for a long time, after such dissolutions, to cause others to be elected; whereby the legislative powers, incapable of annihilation, have returned to the people at large for their exercise; the state remaining in the meantime exposed to all the dangers of invasion from without, and convulsions within. </em></p>
<p>While they don’t have the right to dissolve the state houses, this government is suing them to prevent them from protecting their people from the dangers without.</p>
<p><em>He has endeavored to prevent the population of these states; for that purpose obstructing the laws for naturalization of foreigners; refusing to pass others to encourage their migration hither, and raising the conditions of new appropriations of lands. </em></p>
<p>Again, Barack Obama is suing Arizona obstructing the laws for naturalization of foreigners.</p>
<p><em>He has obstructed the administration of justice, by refusing his assent to laws for establishing judiciary powers. </em></p>
<p>He has consistently challenged the judicial branch. In his State of the Union address, he said, “…last week, the Supreme Court reversed a century of law that I believe will open the floodgates for special interests, including foreign corporations, to spend without limit in our elections.”</p>
<p>A statement that has been proven false, time and again.</p>
<p><em>He has made judges dependent on his will alone, for the tenure of their offices, and the amount and payment of their salaries. </em></p>
<p>The Constitution prevents this, however, from the beginning; our government has sought to bend the judiciary to its will. FDR was the worst, but it has gone on since the colonial days.</p>
<p><em>He has erected a multitude of new offices, and sent hither swarms of officers to harass our people, and eat out their substance. </em></p>
<p>Czars anyone? How about the FCC? I can keep going.</p>
<p><em>He has kept among us, in times of peace, standing armies without the consent of our legislature. </em></p>
<p>We are so far beyond standing armies that this doesn’t really apply.</p>
<p><em>He has affected to render the military independent of and superior to civil power. </em></p>
<p>He has actually affected to render the military useless.</p>
<p><em>He has combined with others to subject us to a jurisdiction foreign to our constitution, and unacknowledged by our laws; giving his assent to their acts of pretended legislation: </em></p>
<p>Our current administration has tried on several accounts to sign treaties that would impose restrictions on the American People that conflict with the guaranteed rights of the Constitution.</p>
<p><em>For quartering large bodies of armed troops among us: </em></p>
<p>No troop quartering yet.</p>
<p><em>For protecting them, by mock trial, from punishment for any murders which they should commit on the inhabitants of these states: </em></p>
<p>Haven’t done that yet.</p>
<p><em>For cutting off our trade with all parts of the world: </em></p>
<p>The government hasn’t cut off our trade, however, with the 2<sup>nd</sup> highest corporate tax rate in the world and signing trade agreements that allow foreign countries to flood our markets with cheap products, while imposing tariffs on our products that essentially prevent us from marketing in those countries, it has helped to destroy trade with other parts of the world.</p>
<p><em>For imposing taxes on us without our consent: </em></p>
<p>58% of the people opposed the Health Care Legislation.</p>
<p><em>For depriving us in many cases, of the benefits of trial by jury: </em></p>
<p>Not yet.</p>
<p><em>For transporting us beyond seas to be tried for pretended offenses: </em></p>

<p><em>For abolishing the free system of English laws in a neighboring province, establishing therein an arbitrary government, and enlarging its boundaries so as to render it at once an example and fit instrument for introducing the same absolute rule in these colonies: </em></p>
<p>The closest thing to this is the Administration’s support of  Mexico, the lawlessness there, and the complete disregard for securing our borders preventing that lawlessness from spilling over.</p>
<p><em>For taking away our charters, abolishing our most valuable laws, and altering fundamentally the forms of our governments: </em></p>
<p>This government, especially the last two administrations, has systematically tried to dismantle the Constitution and attain more power for the government. Specific examples include, the Patriot Act and the government takeover of our industries such as the auto industry and the banking industry.</p>
<p><em>For suspending our own legislatures, and declaring themselves invested with power to legislate for us in all cases whatsoever. </em></p>
<p>Barack Obama suing the State of Arizona telling them that immigration is best left to the federal authorities.</p>
<p><em>He has abdicated government here, by declaring us out of his protection and waging war against us. </em></p>
<p>I wish we had less government here.</p>
<p><em>He has plundered our seas, ravaged our coasts, burned our towns, and destroyed the lives of our people. </em></p>
<p>Well, the people of the Gulf Coast could make an argument about plundering our seas and ravaging our coasts, considering this administration ignored help requests from BP prior to the explosion, and has done everything in its power to prevent anyone from helping clean up the oil spill.</p>
<p><em>He is at this time transporting large armies of foreign mercenaries to complete the works of death, desolation and tyranny, already begun with circumstances of cruelty and perfidy scarcely paralleled in the most barbarous ages, and totally unworthy the head of a civilized nation. </em></p>
<p>The only mercenaries that our government employ is Blackwater. They haven’t turned them on us yet.</p>
<p><em>He has constrained our fellow citizens taken captive on the high seas to bear arms against their country, to become the executioners of their friends and brethren, or to fall themselves by their hands. </em></p>
<p>Since we aren’t at war, this hasn’t been done since the Civil War.</p>
<p><em>He has excited domestic insurrections amongst us, and has endeavored to bring on the inhabitants of our frontiers, the merciless Indian savages, whose known rule of warfare, is undistinguished destruction of all ages, sexes and conditions. </em></p>
<p>Our current administration, while not exciting domestic insurrections, is doing little to prevent the Islamic terrorism that threatens our way of life.</p>
<p><em>In every stage of these oppressions we have petitioned for redress in the most humble terms: our repeated petitions have been answered only by repeated injury. A prince, whose character is thus marked by every act which may define a tyrant, is unfit to be the ruler of a free people. </em></p>
<p>We gather to express disdain; we are lied about in the press, accused of being racist, Nazis and a small minority. When we elect opposition, we are told that we support the actions. We are basically being ignored by those in our current government.</p>
<p>These are just the complaints outlined in the Declaration of Independence. Perhaps it is right on this of all days, to take a look at our current government and how it can be improved.</p>

He is now suing to oppose a requirement that he do his job.</p>
<p>The State of Arizona has been invaded by another country. This invasion is destroying their land, their economy and in many cases taking the lives of citizens of Arizona.</p>
<p>The state passed a law to allow the local law enforcement to assist the federal government in doing it&#8217;s job. A law, like the law in California, is designed to give local law enforcement the authority to find out if someone is an invader of this country.  Instead of thanking them, the Federal Government is using our money to mount a lawsuit to keep the State of Arizona from requiring it do it&#8217;s job.</p>
<p>Barack Obama pretends to be a Constitutional Scholar. See, I couldn&#8217;t even type the words Barack Obama and Constitutional Scholar in the same sentence without having to stop to laugh. Perhaps someone should point out that while no where in the Constitution does it put the Health Care Industry, the Banking Industry, the oil industry, or the press (internet) on the list of things for which the government is responsible, he has rushed to involve the government in those things. Yet, one of the basic responsibilities assigned to the Federal Government, securing our borders, is tossed aside by him. In fact, he is so opposed to securing the borders that he is suing to keep from having to do it.</p>
<p>I have often reminded those who believe that Obama should be impeached, that he has not committed an impeachable offense. You can&#8217;t just remove a President because you don&#8217;t like his policies.  However, the reasons for impeaching a President as defined by the Constitution are: &#8220;The President, Vice President and all civil Officers of the United  States, shall be removed from Office on Impeachment for, and Conviction of, Treason,  Bribery, or other high Crimes and Misdemeanors.&#8221;</p>
<p>Treason is defined in the Constitution in Article III Section 3 as: &#8221;</p>
<p><strong><a name="A3Sec3">Section 3</a> &#8211; Treason</strong></p>

<p>Now, if you ask me, Obama will be committing treason by giving aid and comfort to invaders of this nation. And by filing a lawsuit against the State of Arizona will be admitting it in open court. I believe that if the administration moves forward with this lawsuit, there is a case to impeach Obama for treason.</p>

<p>You all might remember Mr. Marcil from his tea party letter that I posted about a few weeks ago. Well, he&#8217;s ignoring facts again as he spews his nonsense about the Arizona Immigration Law. Again, this idiocy is printed by the St. Augustine Record and can be read <a href="http://staugustine.com/opinions/2010-05-29/letter-law-enforcement-no-fan-ariz-immigration-law#comment-11892" target="_blank">here.</a></p>

<p>Yes, some law enforcement agents oppose the law. The point Mr.  Marcil washes over is that most opposed  it because they believe it will strain local resources. They added,  that it might also make it more difficult to fight crime, as people  might be less willing to talk to police.</p>
<p>However, instead of going off on an emotional, factually baseless  rant about race, perhaps he might look at what the State of Arizona is  facing. The State of Arizona spends over 1.3 Billion dollars per year on  education, health care, and incarceration of illegal aliens. All  because people like Mr. Marcil have no respect for the law and enforcing  it. You see, what he also misses is that the Arizona law applies less  stringent requirements than our federal law. The difference is that the  State and Local agencies of Arizona will actually apply it.</p>
<p>What Mr. Marcil misses in his racist rant is that these people are in  our country illegally. They have not only broken the law, but invaded  our country. We are at war, and people like Mr. Marcil are condemning  acts to secure our borders. This is a matter of National Security and  Mr. Marcil and his ilk just don&#8217;t get it.</p>
<p>I like how he says, &#8220;..remember the words of Friedrich Nietzsche: There are no facts, only  interpretations.&#8221; That is funny coming from a man who consistently ignores facts.</p>
<p>I would feel sorry for them if they weren&#8217;t trying to destroy our nation. The thing that I really feel sorry for is that someone with his inability to factually analyze a situation is allowed to teach. This man is a Professor at Flagler College. This man is teaching the future of our nation. Anyone else a little scared?</p>
